The BBB decisions are considered the end of the arbitration process. The next step would a lawsuit.

I was concerned that Nissan wouldn't honor the BBB decision to replace my battery, but they contacted me shortly after the decision and replaced the battery.

You did a very vigorous legal statement of your position focusing on the defects warranty and the vehicle not matching Nissan's original claims in both your initial claim and appeal.

The other person that reported an out of capacity warranty replacement did many email contacts with several levels of Nissan management.

Sometimes the squeky wheel gets the grease :lol:

My arbitration hearing is scheduled for 1/27 at 10am PST in LA downtown. I'm looking for Leaf owner/volunteers to be my witnesses. I believe participation by phone is sufficient, trying to confirm it. I was a witness in the OP's case, it took about 5 minutes of my time to answer some questions over the phone. Your LEAF was a lot further degraded with five bars missing and a lot more miles.
Did that impact the arbitration?

Does the better business bureau provide arbitration in all fifty USA states?

I only had 4 missing at the time of the hearing, the 5th dropped on the day I was headed to the dealer to install a new pack. 4 lost after 4 years was enough to convince the arbitrator capacity loss wasn't "gradual" and as such the 100k mile warranty should apply. As for mileage, the fact I was still within the 100k mile for the warranty was all that mattered. Unsure about program availability in all fifty states, but even in those where it is available rules are slightly different according to state laws. Better check with BBB Auto Line directly.

Now, don't you wish that the battery that they will put in wasn't just new, but more durable and maybe more kWh? Anyway, you will enjoy the new one over your depleted one.

Wish is a bit of a strong word in this case, but I wouldn't mind it of course :) I'm just happy that now my Leaf will be everything I hoped for when I bought it, too bad it takes 2 batteries and a fight to make it happen.
