More on battery failures

I admit that I'm guessing here, but it appears that a bad pouch exists in module 26. Can someone explain in "laymans" terms how this is handled by the Leaf's battery (2/2) module design and the BMS - so that the entire battery is not significantly (maybe it is?) dragged down - and therefor Nissan can claim it is NOT DEFECTIVE. It appears that that module contains one cell that is well below the lowest voltage limits of an operable cell (2.8 volts/95% plus DOD/<5% SOC). That would appear to be a failed cell rather than a the normal cell imbalances that are within manufacturing tolerances. What am I missing? Is Nissan simply putting off the inevitable - or are "failed cells" just part of the capacity warranty?
