We have had this problem also. The 12V battery is losing charge due to lack of use and we have had a couple of occasions when the car would start, go into "R", but the brakes totally fail.
IMHO, there should be a recall to fix this.
On further inspection, it's not the button staying in, but the door handle coming apart -- the chrome cover is coming away from the rest of the handle.

Since my original post, my Leaf has now lost 1 battery bar. This seems to have happened either while or shortly after the car sat at about 50% battery for a couple of weeks in cold weather. Doing that should not impact the battery ... in fact, it's pretty much ideal for storage.
