Is the "fused disconnect" (that this document lists in its parts lists) required, or just "suggested"?

If required, by whom?

That has to be a typo, you can't use a 40A circuit breaker with 12 gauge wire, that should be #8,
General guidlines:

#14 for 15A circuits
#12 for 20A circuits
#10 for 30A circuits
#8 for 40A circuits

I agree, #12 is wrong.
