So, most importantly everyone in the accident is ok. That said the other guy ran a stop sign and got t-boned by the Leaf but with basically no damage to the big truck, amazing actually. Fault has not been determined, but worst case scenario for us the fault would be 50/50, meaning everyone pays for their own damage, to my knowledge. Either way, the estimate has come up to $13,400 from the body shop which is not a Nissan dealership (does this worry anyone?). The car has almost 10k miles on it; we definitively loved it. I checked eBay completed listing and I think with that information our car would be worth less then $25,000. That said, I think that it should and might get totaled because the estimate is more then 50% of the value of the car and to be honest that would be better for us. Our insurance company is Allstate and the other guys is Progressive. If in face the car gets totaled I am curious what happens to the purchased maintenance and extended warranty we got from Nissan, does it get forfeited or is the prorated amount refunded? We would get another Leaf of course if it comes to that. I was wondering what you Leafers think about all this and what advice you may have. Your comments will be greatly appreciated.

"he" ran a stop sign? well, shouldnt be too tough to assign fault.

the ext warranty is prorated by the month. you may end it at any time and be refunded the remainder so you will get that back as well.

bummer to hear about your LEAF. supposing it had no range loss either? that would figure...

IMHO, I think the damage estimate is too low.

Some dealers don't have a body shop and don't do damage repairs. So, I wouldn't be too worried from that. If they're going to need to put the car in a heat booth, they'll definitely need to remove the battery pack.

have to agree on the low part. airbag deployment is a pretty expensive fix. rare to see it not totaled. now if you are looking to sell your battery pack, i know a few people in AZ who might be interested
 
Well it still might get totaled but we did have the body shop call to see if want to get it done. He didn't "run" the stop sign he just didn't fully stop is what happened if that is anymore accurate. And that you guys are saying its a low estimate is good to hear. Am I accurate on the pre-accident value of the car?

If it's totaled doesn't the ins co get the car?
 
It's good to read that nobody was injured. Sorry to see your baby EV in such a state.

If it's totaled, check out the big $5k discounts currently on offer from a couple of CA dealers. You might just come out ahead on the deal.

Whoops. That's true.
 
Most states don't have laws prohibiting the insurance company from selling the car to the insured with a salvage title, if the insured wants to buy it. Where it's legal, the insurance company usually asks, since that's the easiest way for them to get rid of the car.

I don't think it will be totaled.
 
If the car is not too old since you bought it and they are at fault, I think you can ask for something called "diminished depreciation value" if the car is not totalled as a form to compensate you for loss of value on your car. Someone correct me if wrong.

Was there any damage to the frame? If so, it would be very surprising if it isn't totalled.

Most shops have experience with insurance companies, and know the line between fixable and totalled. There are a lot of grey areas when it comes to "what needs fixin'", and many will work with you to to push the final estimate over the edge if it is close. I actually had that happen with our Odyssey, and was appreciative that the body shop gave me that option, especially since totaling the vehicle meant a lot less money for them.

As others mentioned, you can get a prorated refund on the maintenance and extended warranties. Look at the paperwork and look for the contact numbers.
 
Sorry about your accident, glad no one was hurt. Looking at the damage I'm amazed how the cabin of the car was virtually undamaged.
 
Glad to see nobody was hurt. Looks like it was quite a jolt.

I'd say there is a high likelihood that this will be totaled. My car was almost $11k in repairs and I had far less damage. Mine was just bumper, hood and headlights and one fender, no frame damage like yours appears to have. I don't have the estimate in front of me, but the headlight assemblies were the most expensive portion of the project.

If they do decide to fix it, expect a long wait for parts. Mine was 5 weeks.

Total it, take the money and run. Ins Co. like Alstate will compensate you to your satisfaction. Plus you get the extended warr prorate back. It will never be a decent car. They'll move it on for spare parts and that's it.

Plus, if you wait, you can buy 2013 and get that coveted 6.6 onboard charger and a better heater.

If he didn't come to a complete stop, he DID run the stop sign. More importantly he didn't wait until the cross traffic was clear before proceeding.

Yep it looks like LEAF did a great job of protecting the occupants. And, no fuel lines were ruptured! :mrgreen:
