Nissan Leaf Battery Life Class Action Lawsuit
Here is the full text of the complaint, it looks like an MNL poster is one of the plaintiffs: http://bitly.com/nisssanclassactionsuit

A federal class action lawsuit accuses Nissan of concealing that its Leaf vehicles have a design defect that causes them to prematurely lose battery life and driving range.

California Plaintiff Humberto Klee says Nissan advertises the Leaf’s driving range at 100 miles or less, depending on a number of variables such as road conditions and the weather. What Nissan doesn’t disclose in its advertising, however, is that the advertised driving range is based on the vehicle’s performance only after charging the battery to 100% capacity – which Nissan tells owners not to do because it could cause battery damage, the Nissan Leaf class action lawsuit says.

The Nissan Leaf class action lawsuit is brought on behalf of a proposed Class of all California and Arizona consumers who purchased or leased any 2011 through 2012 Nissan Leaf vehicle. It is asking, among other things, that Nissan remove and replace Class Members’ battery systems with a suitable alternative product, reform its Leaf battery warranty, cover the loss of battery capacity under warranty, and reimburse Class Members for any repairs made. Klee is alleging violations of California’s Consumer Legal Remedies Act, Arizona’s Consumer Fraud Act and Unfair Business Act, negligent misrepresentation, and breach of Implied Warranty under the Song-Beverly Consumer Warranty Act.

Won't happen. At least not for class members. Named plaintiffs, maybe. But class members will end up with something like a $20 service voucher. And the lawyers...the lawyers will make $2,000,000 in legal fees.

Nissan is bying back the affected cars. It's over, folks.

So we can all breathe a sigh of relief and go back driving our Leafs, knowing life is good and the company is doing the right thing.

Two cars. Two cars is all that is known right now. A bit premature to be popping the Champagne corks.

I have a feeling that it "ain't over 'til it's over". At least one of the tested cars was denied by Nissan for a buy back. The ship is turning away from the rocks, but there's gunna be a few scrapes.

Really... When can I expect to hear from them about where to drop off mine??? Pardon me if I don't high-five or hold my breath!

Funny how the division lines run between folks that have lost capacity bars and owners that didn't. It seems to be another incarnation of North against South.

Bring on the Mason-Dixon line! And all the cotton and tobacco we can eat!

Do you get to pick sides? Way more fun to be had in the South. Not to mention warmer weather :)

If you are driving a Leaf, warmer weather may be a negative...
Agreed. I promise to limit my recruiting efforts to drivers of other EVs only. Should be interesting...

Where do I opt-out. I don't need a scumbag, ambulance chaser, taking away my rights.

You should get some mailer to your address of record that you gave Nissan when you acquired your LEAF. It should have the instructions on how to opt out.

I don't believe they are "taking away your rights" though. I personally will not be involved in any lawsuits against Nissan.

Which car was denied and why? Details please!

You can pick sideburns (after General Ambrose Burnside):

I can't give any details. Sorry.

I might be down 2 bars, but I am not participating in lawsuits against Nissan and plan to keep my LEAF for a long time. I will be opting out of any class actions to do my part to minimize the cash for the lawyers.

I say, we let the dust settle on buybacks first. This it Nissan's initial foray into stepping from the ivory tower down to the street level, and showing interest in what has cropped up.

As it stands now, the car not only has a limited range but also ability to tolerate a narrow environmental boundary.

So... To paraphrase the old SF Uncle Gaylord's ice-cream store ad: If you don't live in mild weather evironment (and want to drive a Leaf) MOVE! :D
